WhatsApp's 'Incognito' AI Mode Promises What Meta Has Broken Before: Total Privacy

If the claims hold, this is a genuine first among major tech companies. If they don't, it is the latest in a pattern of privacy promises Meta has struggled to keep.
How It Works: TEEs, Ephemeral Keys, and OHTTP Relays
Incognito Chat is built on WhatsApp's Private Processing infrastructure, first detailed in an engineering blog post in April 2025 [3]. The core mechanism uses Trusted Execution Environments (TEEs) — isolated hardware enclaves running on AMD SEV-SNP confidential virtual machines and NVIDIA H100 GPUs in confidential computing mode [4]. In theory, code running inside a TEE cannot be inspected or modified by the host operating system, the hypervisor, or Meta's own engineers.
When a user sends a message in Incognito Chat, the request is encrypted end-to-end between the device and the TEE using an ephemeral key that Meta and WhatsApp cannot access [3]. Traffic is routed through third-party relays using Oblivious HTTP (OHTTP), a protocol designed to obscure users' IP addresses from Meta's infrastructure [4]. - Weak patch verification: The system initially trusted firmware's self-reported patch levels rather than validating them against AMD's cryptographic certificates, meaning attackers with outdated, vulnerable firmware could appear fully patched [6].
- Attestation replay attacks: Without per-session binding, valid attestation reports could be reused indefinitely, allowing rogue servers to impersonate legitimate WhatsApp processing nodes and intercept messages [6].
Meta says it addressed all 28 issues before launch. Fixes included strict environment variable validation, cryptographic firmware verification, custom bootloaders for hardware integrity checks, and per-session nonces to prevent replay [7]. Trail of Bits concluded that TEEs can enable privacy-preserving AI, but "only with rigorous attention to implementation details" [6].
The audit also flagged unresolved systemic concerns: metadata correlation, geographic targeting through routing patterns, anonymous token correlation with request timing, and limited reproducible builds that prevent independent verification of the secure environment [7]. These are not bugs to be patched — they are architectural constraints.
How It Compares: Apple, Google, and the Privacy Spectrum
Meta's approach closely mirrors Apple's Private Cloud Compute (PCC), which uses custom silicon with dedicated Secure Enclaves for on-device and cloud AI processing [8]. Both systems implement stateless computation where data is deleted after processing, and both invite external researchers to audit their claims [8].
The differences matter. Apple controls its hardware stack end to end, from chip design to data center. Meta relies on third-party AMD and NVIDIA silicon within standard cloud infrastructure [8]. No public evidence indicates that Meta consulted or notified any of these regulators ahead of the Incognito Chat launch. The EU's Irish Data Protection Commission, which serves as Meta's lead supervisory authority in Europe, has not issued a public statement on the feature.
€2.4 Billion in Fines and a Pattern of Broken Promises
The credibility question is not abstract. Meta's track record on WhatsApp privacy commitments is documented in regulatory decisions totaling over €2.4 billion in EU and EEA fines [11][12][13][14].
The most instructive case is the earliest. When Facebook acquired WhatsApp for $19 billion in 2014, both companies told EU regulators and users that they would not link user data across platforms without explicit opt-in consent [15]. The incentive structure is clear: every new surface that generates user interaction creates potential signal for ad targeting. Meta's explicit promise that Incognito Chat data will not be used for advertising [1] requires sustained institutional discipline that runs counter to the company's primary revenue mechanism.
There is no external enforcement mechanism beyond regulatory action after the fact. Meta has not committed to publishing an Incognito Chat-specific transparency report. The company's existing transparency reports cover government data requests across all platforms but do not isolate WhatsApp or break out AI-related disclosures [18]. Without dedicated reporting, there is no way for users or regulators to verify that Incognito Chat data is not quietly being accessed, retained, or repurposed.
Who Benefits — and Who Might Be Harmed
The feature's intended beneficiaries are clear. Journalists using WhatsApp in countries with press restrictions could query an AI about sensitive topics without creating a retrievable record. Activists and dissidents in authoritarian states — where WhatsApp is often the primary communication tool — gain a channel for AI assistance that is harder to surveil. Abuse survivors seeking information about resources or legal options get a space that does not persist on a shared device. Health-related queries, financial questions, and other intimate searches gain a layer of protection [4].
But the same guarantees that protect vulnerable users also shield bad actors. An AI assistant that retains no records and cannot be audited after the fact is equally useful to someone planning violence, coordinating exploitation, or grooming a minor. The updated COPPA rule, enforceable since April 2026, expands children's privacy protections to include biometrics and government-issued identifiers [19], but does not address the specific scenario of minors interacting with ephemeral AI systems.
No public evidence indicates that digital-rights organizations like the Electronic Frontier Foundation, Access Now, or Privacy International were consulted on Incognito Chat's design. Legal Compulsion: The Limits of Technical Privacy
Technical privacy guarantees exist within legal frameworks that can override them. Two U.S. statutes are particularly relevant.
The CLOUD Act, enacted in 2018, allows U.S. law enforcement to compel any U.S.-controlled provider to produce data regardless of where that data is physically stored, provided they obtain a court-issued warrant [20]. In authoritarian markets where WhatsApp is dominant — including countries like India, where the government has demanded traceability of encrypted messages — local law enforcement may make demands that conflict with Incognito Chat's privacy guarantees. Meta has not publicly committed to resisting such demands for AI conversations specifically.
Meta received 81,064 government data requests in the U.S. alone in the first half of 2025, an increase of 8.6% over the prior period. Of those, 77.3% included non-disclosure orders prohibiting Meta from notifying the targeted user [18]. The company has not stated whether Incognito Chat sessions would be categorically excluded from such requests or whether it would publish a separate transparency report covering them.
What Would Make the Promise Credible
The technical architecture of Incognito Chat is, on paper, among the strongest privacy protections any major tech company has offered for AI conversations. The use of TEEs, ephemeral keys, OHTTP relays, and stateless processing represents a serious engineering effort.
But architecture is not accountability. To close the gap between claim and credibility, independent observers have pointed to several measures Meta has not yet taken:
- Reproducible builds: Trail of Bits noted that limited reproducible builds prevent external researchers from independently verifying what code runs inside the TEE [6]. Without this, users must trust Meta's attestation that the enclave runs the software it claims to run.
- Dedicated transparency reporting: A separate report covering government requests for Incognito Chat data, even if the answer is "zero records produced because none exist," would provide a verifiable record.
- Regulatory pre-notification: Engaging the Irish DPC, India's Data Protection Board, and Brazil's ANPD before launch — rather than after — would signal confidence in the feature's compliance.
- Binding legal commitments: A public pledge not to modify the ephemeral processing design without advance notice and independent audit would constrain future backsliding in a way that a blog post cannot.
Meta has built what appears to be a technically sound privacy system. The question is whether the company that broke its first WhatsApp privacy promise within two years of making it has earned the trust to keep this one.
